Despite the same sex prohibition law in Nigeria, many gays and lesbians seem unperturbed as two suspected gay men, Promise Oluwabunkenoye and Kehinde Abiola, have exposed themselves. The duo appeared before a Surulere Chief Magistrate’s’ Court in Lagos State on Wednesday with charges bordering on anal sex. Two gay men fight publicly in Lagos over refusal to pay for anal s*x.

According to the Police Prosecutor, Anthonia Osayande, the accused persons, aged 24 and 29 respectively, with others still at large committed the offences at City Centre Hotel at Ijeshatedo in Surulere about 3.00.p.m. on June 1.

Mr. Osayande said the accused were caught by a police patrol team fighting publicly over non-payment of money for sexual acts. He alleged that during police interrogation, one of the accused confessed to the fact that he was invited to Romeo and Juliet Hotel located at Ejigbo on May 28 at 5.00 a.m. for anal sex.

The prosecutor said, “He promised to pay some money if he consented to the act, but the accused refused to pay after enjoying himself. The offences contravened Sections 54 and 136 of the Criminal Law of Lagos State 2015.

Meanwhile, the accused, whose addresses are unknown, are facing a two-count charge of same-sex having sexual intercourse and fighting in the public‎. The pleaded not guilty to the charges.

In her ruling, the Chief Magistrate, Ipaye Nwachukwu, granted bail to the accused in the sum of N100,000 each with two sureties each in like sum. She ordered ‎that the accused should submit their passport-size photographs to the court registrar. Ms. Nwachukwu said one of the sureties must be a blood relation of the accused, while the other must be a cleric or a community leader.

In addition, the sureties should provide evidence of tax payment to the government. She adjourned the case until August 3 for mention.‎

The Same Sex Marriage Prohibition Act also criminalizes homosexual clubs, associations and organizations, with penalties of up to 14 years in jail. Some Nigerian gays fled the country because of intolerance of their sexual persuasion, and more are considering leaving.

The law now says, “A person who registers, operates or participates in gay clubs, societies or organizations, or directly or indirectly makes public show of same-sex amorous relationship in Nigeria commits an offense and is liable on conviction to a term of 10 years. Anyone convicted of entering into a same-sex marriage contract or civil union faces up to 14 years imprisonment.”
